NJ: RPS amended; Class II renewables tightened

New Jersey has enacted legislation amending the definition of Class II renewables under the state’s RPS by clarifying that Class II renewables include facilities from 3 MW to 30 MW and expressly excludes energy from facilities larger than 30 MW after the law’s effective date. Prior to the enactment of A 3455, Class II renewables included all hydro facilities larger than 3 MW by statute; the 30 MW limit was defined only in the state’s RPS regulations.
