WA: UTC to regulate 3rd-party-owned solar?

The Washington Utilities and Transportation Commission has issued a long-anticipated interpretive statement (Docket No. UE-112133) on the Commission’s jurisdiction to regulate companies that provide 3rd-party-owned solar services. The statement indicates that the UTC generally believes that its jurisdiction extends to regulating third-party owned solar providers, but that any definitive determination would depend on the facts of a specific situation. However, the UTC does not believe that rate regulation would be appropriate and suggests that the current regulatory structure applicable to competitive providers of telecommunications services (registration and public posting of prices) is more suitable. Due to the case-specific nature of the issue from the UTC’s perspective, and the accompanying uncertainty, the UTC indicated that the best course of action would be for the state’s legislature to address this issue during the 2015 session.
