COSEIA recently filed an emergency motion asking the Colorado Public Utilities Commission to enforce a prior decision that COSEIA believes does not allow Xcel Energy to accept bids for negative REC prices. Last month, Xcel submitted an RFP for its Solar*Rewards Community (solar garden) program that allowed subscriber organizations to bid negative REC prices. COSEIA stated that the PUC’s original decision approving and extending Xcel’s RPS Compliance Plan for 2014-16 not only did not authorize negative bid pricing, but that it also raises important policy questions about the application of RECs to RPS compliance if the utility has not paid for them. The PUC rejected COSEIA’s emergency motion.
