DE: Proposed regs could pave way for RPS freeze

Delaware’s Division of Energy and Climate has proposed regulations to govern when and whether it may institute a freeze on the state’s existing RPS. (The Division of Energy and Climate is part of the Department of Natural Resources and Environmental Control.) Written comments are invited. The Public Advocate has filed comments questioning the basic authority of the Department to promulgate such rules, and has petitioned the Public Service Commission to promulgate the rules instead of the DNREC, claiming that the PSC — not the DNREC — is authorized to do so.
