Empire District Electric has filed an amended RPS plan that addresses how the utility intends to meet its obligations under the 2% solar carve-out within Missouri’s RPS, established by Proposition C. Empire previously operated under an assumption that it was exempt from the solar carve-out and a requirement to provide PV rebates; its prior RPS compliance plans and reports did not address solar compliance. However, a Missouri Supreme Court decision in April 2015 found that the statutory exemption from payment of solar rebates that Empire had relied upon had been repealed by Proposition C. Empire has since established a PV rebate program, which took effect on May 16, 2015.
